TradeVow — Terms and Conditions

These Terms and Conditions ("Terms") are a legal agreement between you and TradeVow ("TradeVow," "we," "us," or "our") governing your access to and use of the TradeVow mobile app and the website at https://tradevow.app (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

TradeVow is operated by an individual sole developer, Brandin Coleman.

1. What TradeVow is — and what it is not

TradeVow is a self-reported trading-discipline journal. It lets you define your own trading rules, check in once per trading day on whether you followed them, record your own daily profit and loss and notes, and build a streak that reflects your self-reported discipline.

TradeVow is not a financial service. Please read this carefully:

• TradeVow does not provide investment, financial, tax, legal, or trading advice, and nothing in the Service is a recommendation to buy, sell, or hold any security, contract, currency, or other instrument.
• TradeVow does not execute, place, route, or facilitate any trade or transaction.
• TradeVow does not connect to any brokerage, exchange, or trading account, and does not access, hold, transfer, or manage any money, funds, securities, or other assets.
• TradeVow is not a broker-dealer, investment adviser, exchange, or money-services business, and is not registered as any of these with any regulator.
• All rules, profit and loss figures, notes, and outcomes in the app are self-reported by you. We do not verify, audit, or independently source any of them. Streaks and statistics are calculated only from what you enter.

You are solely responsible for your own trading and financial decisions and their consequences. Trading carries significant risk of loss. You should consult a qualified, licensed professional before making financial decisions.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. TradeVow is intended for adults and is not directed to children. By using the Service you represent that you meet this requirement and that you are legally able to enter into these Terms.

3. Your account

To use the Service you create an account using your email address or "Sign in with Google." You agree to provide accurate information, to keep your login credentials secure, and to be responsible for all activity under your account. Notify us promptly at tradevowtrading@gmail.com if you believe your account has been accessed without your authorization. You may not share your account, or use another person's account without permission.

4. Subscriptions, free trial, billing, and cancellation

TradeVow is free to download. Certain features require a paid subscription ("TradeVow Pro").

Plans and pricing. TradeVow Pro is offered as:

• Monthly — $7.99 per month, and
• Annual — $59.99 per year.

Both plans include a 3-day free trial for new subscribers. Prices are shown in the app in your local currency and may vary by region and over time.

Free trial. If you start a free trial, you will not be charged during the trial period. Your subscription automatically converts to a paid subscription and you will be charged the applicable price at the end of the trial unless you cancel at least 24 hours before the trial ends. If you begin a trial and then purchase or the trial converts, any unused portion of the trial is forfeited.

Billing and auto-renewal. Subscriptions are sold and billed through your Apple App Store account, not by us directly. Your subscription automatically renews at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.

Managing and cancelling. You can manage or cancel your subscription, and turn off auto-renewal, at any time in your device settings: Settings → Apple Account → Subscriptions. Cancellation takes effect at the end of the current billing period; you keep access to paid features until then.

Refunds. All purchases are processed by Apple and are subject to Apple's refund policies. We do not process payments and generally cannot issue refunds directly; refund requests are handled by Apple through the App Store.

Deleting your account does not cancel a subscription. Deleting your TradeVow account does not by itself cancel an active App Store subscription. You must cancel through Apple as described above.

5. Your content

You retain ownership of the content you create in the Service, including your rules, check-ins, profit and loss entries, notes, and other journal data ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to operate the Service for you — for example, to show your history, compute your streaks, and let you review and export your own records. We do not sell Your Content and we do not use it for advertising. Our handling of Your Content is described in the Privacy Policy.

You are responsible for Your Content and represent that you have the right to submit it and that it does not violate these Terms or any law.

6. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• reverse engineer, decompile, or attempt to extract source code from the app, except to the extent this restriction is prohibited by law;
• interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its supporting infrastructure;
• upload malware or any harmful code, or attempt to circumvent security or usage limits;
• resell, sublicense, or commercially exploit the Service without our written permission; or
• use the Service to impersonate others or misrepresent your affiliation with any person or entity.

We may suspend or terminate access that we reasonably believe violates these Terms.

7. Intellectual property

The Service, including its software, design, branding, name, logo, and content we provide (but excluding Your Content), is owned by TradeVow and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial use in accordance with these Terms and the applicable app-store rules. All rights not expressly granted are reserved.

8. Third-party services

The Service relies on third-party providers to function, including Supabase (backend, hosting, authentication, and database), Google (optional "Sign in with Google"), and Apple and RevenueCat (purchase and subscription processing). Your use of those features may also be subject to those providers' terms and policies. We are not responsible for third-party services, and their availability is outside our control. Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of data loss, or that any streak, statistic, or output will be accurate, since all inputs are self-reported by you. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, TradeVow and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, trading losses, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages. This includes, without limitation, any losses connected to trading or financial decisions you make.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) fifty US dollars ($50).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnification

You agree to indemnify and hold harmless TradeVow and its operator from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Termination

You may stop using the Service and delete your account at any time from within the app (Settings → Delete account). We may suspend or terminate your access if you materially violate these Terms, if required by law, or if we discontinue the Service. On termination, the license granted to you ends and you must stop using the app; the sections of these Terms that by their nature should survive (including Sections 1, 5, 7, 9, 10, 11, and 13) will survive. Deleting your account does not cancel an active App Store subscription (see Section 4).

13. Governing law and disputes

These Terms are governed by the laws of the State of Idaho, USA, without regard to its conflict-of-laws rules. Subject to applicable law, you agree that the state and federal courts located in Idaho will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction there. If you are a consumer resident in a jurisdiction (such as the EU or UK) whose law grants you the right to bring claims in your local courts or to the protection of mandatory local consumer laws, nothing in this section removes those rights.

14. Changes to the Service and to these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the app. Your continued use of the Service after an update means you accept the revised Terms. If you do not agree to the changes, stop using the Service and, if you wish, delete your account.

15. Apple App Store terms

These Terms are between you and TradeVow only, not with Apple. To the extent the app is obtained through the Apple App Store, the following also apply and, together with Apple's standard Licensed Application End User License Agreement, govern your license to use the app:

• Scope of license. The license granted to you is limited to a non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
• Maintenance and support. TradeVow, not Apple, is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish support.
• Warranty. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims are our responsibility, not Apple's.
• Product claims. TradeVow, not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal requirements, and consumer-protection claims.
• Intellectual property. In the event of a third-party claim that the app infringes intellectual-property rights, TradeVow, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting," and that you are not on any US Government list of prohibited or restricted parties.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

16. General

These Terms, together with the Privacy Policy, are the entire agreement between you and TradeVow regarding the Service. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
